Right to Refuse Work Policy Template
A right to refuse work policy template confirming that workers can refuse to start or continue work where they reasonably believe there is serious and imminent danger to themselves or others, without being disciplined or suffering any other detriment.
The policy has Approved By and Date Approved fields and carries a Public information classification, so it can be shared with workers, clients and other interested parties.
What the Right to Refuse Work Policy Covers
- The right to refuse work - the protection for workers who leave, refuse to return or take steps to protect themselves or others from serious and imminent danger
- Notification and response - how a worker stops work and reports it, a written record of the report, and an investigation by the H&S Lead or appointed person
- Interim action - actions to mitigate the hazard or reduce the risk while the report is investigated
- Continuation of work - work only continues when the hazard is eliminated or the risk reduced to an acceptable level, and no one is asked to return while serious and imminent danger remains
- Escalation - a worker who still believes the danger is serious and imminent is not required to return while the matter is referred higher
- Review - at least once a year at management review
Two Versions Supplied
The main policy is generic and does not name legislation. P-12 Right to Refuse Work Policy (V2) names the Employment Rights Act in the body and adds a legislation section.
Using the Policy
Add your company name and logo, check each commitment matches what your organisation does and edit any that do not, then approve and date the policy and share it with workers and anyone else who needs to see it.
Who Needs a Right to Refuse Work Policy?
Organisations working to ISO 45001, and any employer whose work involves hazards where a worker may need to stop work to protect themselves or others.
Included in the ISO 45001 Toolkit
This policy is part of the ISO 45001 Toolkit and is also included in the ISO 14001 toolkits and every alphaZ ISO toolkit that combines them.
Works with the Health and Safety Policy Procedure
The PP-7-100 Health and Safety Policy Procedure sets out the wider health and safety arrangements, including risk assessment, that sit behind this policy.
Document Control
The footer carries the policy number and title, information classification, version and page numbers, and the approval fields record who approved the policy and when, so it can be controlled with the rest of your management system documents and listed on a document register such as the F-IMS20 Document Register.
